MEMORANDUM OPINION AND ORDER THIS MATTER comes before the Court on Defendant FedEx Ground Package System, Inc.’s Motion for Partial Summary Judgment on Plaintiff’s Claim of Aiding and Abetting, filed November 16, 2015 (Doc. 68)(“Motion”). The Court held a hearing on December 22, 2015. The primary issue is whether the Court should grant summary judgment in favor of Defendant FedEx Ground Package System, Inc. on Plaintiff Elia Leon’s claim that FedEx Ground aided and abetted truck driver Federico Martinez-Leandro’s violations of his duties towards decedent Martin Leon. The Court will grant the Motion because it concludes that E. Leon cannot recover on any of her three possible aiding-and-abetting theories.
